VERNONIA SCHOOL DISTRICT V. ACTION (1995)
James Acton, a 12-year-old seventh-grader at Washington Grade School in Vernonia, Oregon, wanted to try out for the football team. His school required all student athletes to take drug tests at the beginning of the season and on a random basis during the school year. James's parents refused to let him be tested because, they said, there was no evidence that he used drugs or alcohol. The school suspended James from sports for the season. He and his parents sued the school district, arguing that mandatory drug testing without suspicion of illegal activity constituted an unreasonable search under the Fourth Amendment.
[HOW DO YOU THINK THE SUPREME COURT RULED?] [DO YOU AGREE OR DISAGREE WITH DRUG TESTING FOR HIGH SCHOOL ATHLETES? EXPLAIN]

80 Comments:
they ruled for the school yes they should
8:05 AM
they probably went with the school
8:07 AM
they probably went with the school
8:07 AM
for the parents . i mean come on he is only twelve years old, there is no suspicion tell the school board to stop being so thirsty.
8:09 AM
i agree if he was not smoking crack or anything whats the big deal wit getting a drug test
8:09 AM
there going to rule for the school because he might do drugs or drink and his mom and dad might not know
8:11 AM
i think the supreme court ruled in favor of the school. i dont agree with drug testing for high school athletes but its gona happen
8:12 AM
I think the Supreme Court ruled in favor of the school. And I believe in drug testing for high school athletes just because there is no evidence doesn't mean he isn't doing drugs.
8:13 AM
I DONT THINK THAT NO SPORTS PLAYERS EXCEPT FOR THE PROS SHOULD HAVE TO BE TESTED U NEVER HEAR ANYTHING BOUT THE MIDDLE OR HIGHSCHOOL BUT U DO HEAR BOUT THE PRO ATHLETES
8:13 AM
i think they choose the school. yes , because more and more student are starting to do that kindof stuff and i dont think that it would be fair for other players
8:15 AM
I see were the parents are coming from and I can see were the school is coming from. The school dont want there kids that are representing their school to be using drugs or drinking but then again the kids 12 years old i highly doubt that he is using any sort or drugs or drinking. But ... I dont understand why his parents are flipping out so bad. But then again i dont think it was that serous to the point were they had to suspend the boy from sports.
8:16 AM
i think that they ruled for the school because the drug test is mandatory and all the students that want to play sports have to take it so he shouldnt be the one that dont have to take it even if there is no evidence of him using any drugs.
yes i do agree with it because then the schools need it in order if some kids are using it and trying to play sports because if something happen to them while playing they cant be guilty for it so they can stop all of that drama with the drug test.
8:16 AM
i think the supreme court ruled differently from the mothers point of view. yes i think schools should have random drug test because drugs can make you slower and you might not do as well and down the road it will effect you.
8:16 AM
I think the school shouldn't suspend james for something like that. They should just not let him play until he took the test. Some high school athletes like to take steroids for better performance when there playing. Now thats what they should be tested for.
8:16 AM
I do agree b/c somebody could be using steriods or something and that would not be fair to the other students.
8:17 AM
i agree, i agree the school should have drug test 4 student who want to play sports because if student are using drug should not play because they could have a heart attack and it will help student to be healthy and athlete.
8:22 AM
They dismissed the case. I do agree with drug testing because it will keep the athletes clean and they might convinse others to be drug free too.
8:25 AM
i believe the supreme court ruled justly. if her son wasn't using drugs, then i dont see why it was such a big reason as to why he didnt take the drug test!
I agree with the drug test because i feel as though our athletes ahould be healthy athletes. We're depending on our athletes to make our sports teams look good. Not only out on the fields, or whever their sport may be, but also in classes. I dont want to have to rely on athletes who do drugs. Drugs can have a big effect on how a team player might payer. So I think its best that they require the drug test so that we have the best athletes possible.
8:30 AM
the court probably rule for the school in that case. yes they should
8:52 AM
they ruled for the scgool and i believe they did the right thing
8:53 AM
the school probbabally won but i belive the lady should have woe because she is right
8:53 AM
the court probably ruled in favor of the school, and i dont think that drug tests in school are fair
8:53 AM
i agree because then you would have unfair advantages if you are on drugs.
8:57 AM
yes they should
8:59 AM
I think they ruled for the school. Just because theres no sign of him doing drugs doesn't mean he isn't
9:02 AM
I don't know how the Supreme Court ruled on this case. In a way there should be drug testing for high school athletes because you don't what people are taking.
9:04 AM
I think there shouldnt be drug tests cause its not bout what you do in life its how you play the sport, and if you play better "high" on the field and what not then go ahead.
9:04 AM
I disagree with the drug testing for high school athletes because just like the way the parents felt about the situation if there is no evidence of drug use then there shouldn't be a reason for drug testing.
9:04 AM
DISAGREE, WHY TEST SOMEONE IF U HAVE NO EVIDENCE OF THEM USING DRUGS
9:05 AM
I agree that little boy aint no different that nobody on that team so he should do it jus like the other unless there hidding something WOOP WOOP WOOP!!!LOL
9:07 AM
i think that they went with the skool i think that if they want to give kids drug tests then if the kids dont do drugs then they sould have nothing to hide
9:08 AM
there should'nt be drug testing and random drug esting in middle school sports probally if the were on probahtion
9:09 AM
i agree because if you start early then they will be trained for collfoeges
9:11 AM
i agree
9:13 AM
thats stupid cuz i dont think to many 12 year olds do drugs
9:14 AM
I agree because with all these athletes usein drugs they need to have a drug test in all school's
9:14 AM
Well i agree with the school because if there was no drug use for him it wouldnt be no problem so he can just gone an take the test
9:14 AM
I think the court didnt rule very well because if the boy wanted to play he had to go by the rules. Yes i do agree with the testing of the high school athletes because if your planning on playing sport why are you using drugs or alcohol and the boy might have did it before or do, do it and haven't told his parents before.
9:15 AM
I think the court ruled for the school bcaz it was mandatory school district rule and if one was taking drugs it would give them an unfair advantage over other schools.
9:15 AM
i think that he did da rite thing in not takin the test.
9:21 AM
i think that the school was right for giving the random drug test during sports. with so many kids doing steroids and a flashback to the past a reason for drug testing
9:22 AM
i agree because if it is not priorly known that the student is a drug user than is not need to invade his privacy
9:26 AM
yeah they should. they went with the school
10:29 AM
they ruled the school because 7th graders should not be using drugs
10:38 AM
I agree with both sides...the schools don't want there students to be on drugs so they have drug tests througout the year..maybe they should do it to everyone instead of just athletes, also I can see where the parents come in...there son is only 12 years old he probably has never even seen drugs or attempted to take any type of drugs.
10:39 AM
I think that the supreme court ruled in favor of the school because to get certain oppertunities there are certain requirement just like obtaining a job.
10:39 AM
i think they ruled in his favor there was no evidence of drug use.
10:40 AM
well um I think that the school did have the right to do that and if he doesn't like the rules than I think he can jus leave the team
10:41 AM
I think they would go with the school.
10:42 AM
No, I dont disagree if you dont have nothing to hide you should take the test!
10:42 AM
i think the parents were right for doing that because if someone doesnt do drugs they shouldnt have to be tested for it
10:43 AM
Well I tink the school have the right to give a durg test if they want to .
10:43 AM
education first,, so they probably went with the school and demanded that if a student wanted to be active in any sport that they would need to take the mandatory drug test, personally, a mandatory drug test can go both ways, but i don't see the harm in not wanting to take a mandatory drug test and still b eligible to play sports......
10:45 AM
I DISAGREE WITH SCHOOL DRUG TESTING. IF THEY DO NOT HAVE ANY SUSPICIONS ABOUT THE PERSON, THEN THEY HAVE NOT RIGHT TO TEST THEM FOR ANYTHING. THE FOURTH AMENDMENT PROTECTS US FROM UNREASONABLE SEARCHES AND SEIZURES SO THEY DID THE RIGHT THING WITH TAKING THE CASE TO COURT.
10:47 AM
i think they probably ruled with the school. i thinnk they should have drug tests because really logically what 12year old is thinking about drugs besides thinking about girls.and i think they should have not suspended him HE IS 12YEARS OLD.
10:48 AM
They ruled for the school.no he can not play
10:51 AM
I don't know. I agree with them having to take drug tests because you want to make sure that the students are not doing drugs
10:53 AM
they ruled yes because it is self to get all of the students drug test to make sure no one is using them.
10:57 AM
He shouldn't take the test, the supreme court ruled n favor of the parents
11:00 AM
IN A WAY I THINK IST WAS RIGHT FOR THEM TO DO THAT BECAUSE THEY WANT TO MAKE THERE PLAYERS ARE CLEAN AND IN GOOD HEALTH BECAUSE USING DRUGS WOULD BE NOT A GOOD ROLE MODEL
11:01 AM
i believe the parents were in the wrong it is a school rule. the school doesnt need evidence to give a drug test and they just wanna make sure no drug activity is going on if there is evidence or not
12:09 PM
i believe the parents were in the wrong it is a school rule. the school doesnt need evidence to give a drug test and they just wanna make sure no drug activity is going on if there is evidence or not
12:10 PM
not sure how they ruled . yes i agree with drug and alchol testing but, only with the premission of the parents and the student and if they are suspected of using drugs.
12:10 PM
What did he have to hide the skool won
12:12 PM
they probably went with the school as they should have i dont see anything wrong with drug testing and if he wasnt wrong then why not just take the test
12:13 PM
for the parents. he is only 12 i would talk to the school board
B.abrams
12:14 PM
i disagree with the drug testin, because there is no reason to test the players unless the had an incident prior to
12:16 PM
they might of transferred schools
12:17 PM
Just take the stupid test, It isnt going to hurt him quit being a #$^ i mean baby
12:21 PM
in my opinion the parents probably had something to hide and the courts ruled in favor of the schools. its mandatory and they need to learn how to deal with it
12:26 PM
the court ruled against him. i agree with the testing athletes. cause nobody should be playing sports while using drugs
12:31 PM
they ruled by there was no evidence to put on him so there was no reason they should of suspend him. disagree because it wasn't the whole school fault it was a random person.
12:31 PM
Thirsty!!! Of course the supreme court went with the school system. I don't think
12:32 PM
THEY RULED FOR SCOOL YES THEY SHOULD
12:33 PM
i think the skool going to win this one
12:35 PM
I disagree because if there is no suspision let the kids play.
12:35 PM
they probably went the school.
12:39 PM
that case could have gone either way because the school isnt in the wrong because they would rather be safe than sorry and the family just feels that it is not nessery it dosent really matter if the schools do the test or not because the athlets should have nothing to hide we know not to do drugs and drink so it should be no problem
12:39 PM
there isnt a big deal o get a drug test.
12:43 PM
I DONT THINK THAT THEY SHOULDNT LET THE KIDS TAKE A TEST THATS NOT RIGHT THEY ARE ONLY 12 AND 11.......THE COURTS SHOULD RULE AGAINST THE SCHOOL
12:14 PM
