VERNONIA SCHOOL DISTRICT V. ACTION (1995)

James Acton, a 12-year-old seventh-grader at Washington Grade School in Vernonia, Oregon, wanted to try out for the football team. His school required all student athletes to take drug tests at the beginning of the season and on a random basis during the school year. James's parents refused to let him be tested because, they said, there was no evidence that he used drugs or alcohol. The school suspended James from sports for the season. He and his parents sued the school district, arguing that mandatory drug testing without suspicion of illegal activity constituted an unreasonable search under the Fourth Amendment.

I think the Supreme Court ruled in favor of the school. And I believe in drug testing for high school athletes just because there is no evidence doesn't mean he isn't doing drugs.

I DONT THINK THAT NO SPORTS PLAYERS EXCEPT FOR THE PROS SHOULD HAVE TO BE TESTED U NEVER HEAR ANYTHING BOUT THE MIDDLE OR HIGHSCHOOL BUT U DO HEAR BOUT THE PRO ATHLETES

i think they choose the school. yes , because more and more student are starting to do that kindof stuff and i dont think that it would be fair for other players

I see were the parents are coming from and I can see were the school is coming from. The school dont want there kids that are representing their school to be using drugs or drinking but then again the kids 12 years old i highly doubt that he is using any sort or drugs or drinking. But ... I dont understand why his parents are flipping out so bad. But then again i dont think it was that serous to the point were they had to suspend the boy from sports.

i think that they ruled for the school because the drug test is mandatory and all the students that want to play sports have to take it so he shouldnt be the one that dont have to take it even if there is no evidence of him using any drugs.

yes i do agree with it because then the schools need it in order if some kids are using it and trying to play sports because if something happen to them while playing they cant be guilty for it so they can stop all of that drama with the drug test.

i think the supreme court ruled differently from the mothers point of view. yes i think schools should have random drug test because drugs can make you slower and you might not do as well and down the road it will effect you.

I think the school shouldn't suspend james for something like that. They should just not let him play until he took the test. Some high school athletes like to take steroids for better performance when there playing. Now thats what they should be tested for.

i agree, i agree the school should have drug test 4 student who want to play sports because if student are using drug should not play because they could have a heart attack and it will help student to be healthy and athlete.

They dismissed the case. I do agree with drug testing because it will keep the athletes clean and they might convinse others to be drug free too.

i believe the supreme court ruled justly. if her son wasn't using drugs, then i dont see why it was such a big reason as to why he didnt take the drug test!

I agree with the drug test because i feel as though our athletes ahould be healthy athletes. We're depending on our athletes to make our sports teams look good. Not only out on the fields, or whever their sport may be, but also in classes. I dont want to have to rely on athletes who do drugs. Drugs can have a big effect on how a team player might payer. So I think its best that they require the drug test so that we have the best athletes possible.

I think there shouldnt be drug tests cause its not bout what you do in life its how you play the sport, and if you play better "high" on the field and what not then go ahead.

I think the court didnt rule very well because if the boy wanted to play he had to go by the rules. Yes i do agree with the testing of the high school athletes because if your planning on playing sport why are you using drugs or alcohol and the boy might have did it before or do, do it and haven't told his parents before.

I agree with both sides...the schools don't want there students to be on drugs so they have drug tests througout the year..maybe they should do it to everyone instead of just athletes, also I can see where the parents come in...there son is only 12 years old he probably has never even seen drugs or attempted to take any type of drugs.

education first,, so they probably went with the school and demanded that if a student wanted to be active in any sport that they would need to take the mandatory drug test, personally, a mandatory drug test can go both ways,but i don't see the harm in not wanting to take a mandatory drug test and still b eligible to play sports......

I DISAGREE WITH SCHOOL DRUG TESTING. IF THEY DO NOT HAVE ANY SUSPICIONS ABOUT THE PERSON, THEN THEY HAVE NOT RIGHT TO TEST THEM FOR ANYTHING. THE FOURTH AMENDMENT PROTECTS US FROM UNREASONABLE SEARCHES AND SEIZURES SO THEY DID THE RIGHT THING WITH TAKING THE CASE TO COURT.

IN A WAY I THINK IST WAS RIGHT FOR THEM TO DO THAT BECAUSE THEY WANT TO MAKE THERE PLAYERS ARE CLEAN AND IN GOOD HEALTH BECAUSE USING DRUGS WOULD BE NOT A GOOD ROLE MODEL

that case could have gone either way because the school isnt in the wrong because they would rather be safe than sorry and the family just feels that it is not nessery it dosent really matter if the schools do the test or not because the athlets should have nothing to hide we know not to do drugs and drink so it should be no problem
